USPTO to Karsten: not so fast with .PING

Trademark office sends office action to PING Golf brand owner. On Wednesday I posted a list of 115 trademark applications that could be related to new top level domains, along with their current status. The USPTO has a policy of not granting trademarks on top level domains, and the number of “speculative” trademark applications has ballooned as ICANN gets ready to expand the TLD universe

It’s go-time for .xxx as www.Buy.xxx commercials make a buzz

.XXX opens for registration today. At the time of writing the .xxx domain name launch is just two hours away and the internet is buzzing thanks to an aggressive TV ad campaign. The ads tell visitors to visit www.Buy.xxx, where you’ll find a list of accredited registrars who will sell you a .xxx domain name. But many of those registrars have already closed their queues for the first few hours of today’s launch. Some of them had a deadline of yesterday to pre-order domains

Did You Know? No Policy Against Registry-Registrar Cross-Ownership

ICANN has never had a formal policy against registry-registrar cross-ownership. ICANN CEO Rod Beckstrom has responded to European Commission Commissioner Neelie Kroes on the issue of cross ownership between domain name registrars and registries, also know as vertical integration. Kroes sent a letter to Beckstrom in June expressing concern over vertical integration and potential competition concerns

.HIV Domain Name Initiative Turns to Crowd Funding

A charity top level domain wants you to be charitable to get it off the ground. A group hoping to launch the .HIV top level domain name is turning to crowdfunding to raise the six figures required to apply for the domain. The idea is that companies can use a .hiv domain in addition to .com to generate money for HIV/AIDS research. The group’s site says that money will be earned with each click to a .hiv web site, although it’s unclear if the owner of the second level domain is the one that ends up making the donation. The group is raising money through crowdfunding platform indiegogo.com .

.XXX Is Going to Make a Whole Lot of Money

Latest six figure sale is a sign of things to come. ICM Registry’s sale of gay.xxx for $500,000 is simply staggering. If there was any doubt before, the company is clearly going to make a mint. This also shows that second level domains in relevant new top level domain names will sell for a lot more than the same second level in a generic TLD (save for .com and and perhaps .net and .org). ICM says it has now sold nine premium .xxx domain names for $100,000 or more

Trying to get a domain name that existed before your trademark. I’m a big supporter of intellectual property rights. Unfortunately I’m stuck writing more often about lawyers and companies that overstep their bounds. The latest case: Smart Tax Holdings, LLC.
